Terms of Service

These Terms of Service (“Terms”) set out the basis on which HFT Building & Pest Inspections (“HFT”, “we”, “us”, “our”) provides our website and inspection services to you (“you”, “the Client”). By accessing our website, requesting a quote, or engaging us to perform an inspection, you agree to be bound by these Terms.

1. About Us

HFT Building & Pest Inspections is a division of HFT Construction Pty Ltd (ABN 54 623 778 227, ACN 623 778 227), a Queensland-based business providing building, pest, pre-purchase, pre-sale, construction stage and commercial property inspections. Our inspectors hold the licences and insurances required to perform the services we offer, including QBCC Licence No. 15096995.

2. Engagement & Quotes

All quotes provided by HFT are valid for 30 days from the date of issue unless otherwise stated. A quote does not constitute a booking; an inspection is only confirmed once we have agreed a date and time with you in writing (including by email or SMS).

By confirming a booking you warrant that you have the authority to engage us to inspect the property and that you will arrange access at the agreed time.

3. Scope of Inspection

Our inspections are conducted in accordance with the relevant Australian Standard for the type of inspection requested (for example, AS 4349.1 for residential pre-purchase property inspections and AS 4349.3 for timber pest inspections). Each inspection is a non-invasive, visual inspection of readily accessible areas of the property at the time of the inspection.

The following are not within the scope of a standard inspection unless expressly agreed in writing:

• Areas that are concealed, locked, obstructed or unsafe to access
• Dismantling of any part of the building, fixtures or fittings
• Detection of latent or hidden defects
• Identification of asbestos, mould, lead, or other hazardous materials beyond visible indicators
• Engineering, geotechnical, plumbing pressure, electrical compliance or gas testing
• Estimates of repair costs, except as a non-binding indication where requested
• Valuations of the property

Where an issue is identified that is outside the scope of our inspection, we may recommend that you engage a suitably qualified specialist for further assessment.

4. Reports

Reports are prepared solely for the Client named on the quote and are not transferable to any third party without our prior written consent. Reports reflect the condition of the property at the time of inspection only and should not be relied on for any other date.

Reports are typically delivered within 24 hours of the inspection by email. Same-day delivery may be available on request and at our discretion.

5. Fees and Payment

Our fees are set out in the quote provided to you. Unless otherwise agreed in writing, payment is due in full on or before the release of the report. Reports will not be released until cleared payment has been received.

We accept payment by bank transfer or by such other means as we may notify you from time to time. All fees are inclusive of GST where applicable.

6. Cancellations and Rescheduling

You may reschedule or cancel a booking without charge if you give us at least 24 hours’ notice. Cancellations or reschedules made within 24 hours of the scheduled inspection time may incur a fee of up to 50% of the quoted price to cover travel and allocated time. If our inspector attends the property and is unable to gain access, the full inspection fee is payable.

7. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law where such exclusion would be unlawful. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the services or these Terms is limited, at our option, to:

• Re-supplying the inspection or the relevant part of the inspection; or
• Refunding the fees paid by you for the inspection.

We are not liable for any indirect, consequential or economic loss, loss of profits, or loss of opportunity arising in connection with our services, except where such liability cannot be excluded by law.

8. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is owned by or licensed to HFT and is protected by copyright and other intellectual property laws. You may view and print pages from the website for personal, non-commercial use only.

All inspection reports, photographs and supporting materials remain the intellectual property of HFT. The Client is granted a non-exclusive, non-transferable licence to use the report solely for the purpose for which it was commissioned.

9. Website Use

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, this website by any third party. We reserve the right to make changes to the website, including the content, services and pricing information, at any time without notice.

While we make reasonable efforts to keep the information on our website accurate and up to date, we do not warrant that it is free from errors or omissions, and we accept no liability for any inaccuracies.

10. Privacy

Our handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. You and HFT submit to the non-exclusive jurisdiction of the courts of Queensland in respect of any dispute arising out of these Terms or our services.

12. Changes to These Terms

We may update these Terms from time to time. The most recent version will always be available on this page. The Terms in effect at the time you engage our services will apply to that engagement.
